Lyoness/Lyconet insolvencies: The international search for the former top marketers

International insolvency proceedings are ongoing – contact sought with former sales executives

Insolvency proceedings have been initiated for the Lyoness, Lyconet, and myWorld groups of companies. However, the real investigation is only now gaining momentum as the data is analyzed and the extent of the financial damage becomes clearer.

While insolvency administrators secure assets, analyze payment flows, and examine international corporate structures, the focus is increasingly shifting to those individuals who, for many years, were among the most recognizable faces of the global distribution system. The investigation now delves many years into the development of Lyoness as well.

A recent document obtained by the editorial team confirms the importance of individual top marketers within the international sales system of that time. The official program of the Lyoness Vancouver Workshop, held on May 3rd and 4th, 2014, lists several of these individuals as members of the so-called ” President’s Team” or as participants in the VIP panel.

The top sales level of the system

According to the documents currently available, the following individuals, among others, belonged to this international sales management level:

  • Helfried Liebscher          (Austria)
  • Stephanie Nielsen          (Norway )
  • Jakub Baclawski             (Poland)
  • Andrea Rosgen                (Germany)
  • Roy Beyer                         (Germany)
  • Aniko Molnar                   (Hungary )
  • Sandra Molnar                 (Hungary )
  • Richard Gozdek               (Poland)

They appeared at international events as speakers, moderators, or trainers and were for many years part of the sales force that represented the Lyoness system worldwide at that time. These individuals held no official positions within the companies, but were at the forefront of marketing and sales.

The investigation continues.

The insolvency proceedings show that the restructuring of the corporate group is far from over.

FURTHER STEPS / NEXT REPORT
We are currently awaiting receipt of the proceeds from the sale of the driving rights. Once these funds have been received, the estate’s insufficiency of assets is expected to be resolved.
At the same time, we intend to complete the data analysis as far as possible in order to obtain further evidence regarding potential liability and avoidance claims.

(7) Claims and Causes of Action

At the time insolvency proceedings were opened, the debtor held numerous claims against affiliated group companies. We have filed claims in all insolvency proceedings involving group companies, both domestically and internationally, of which we are aware. Where no insolvency proceedings have been initiated, we have sent formal demand letters. As expected, these have largely remained unanswered.

Together with the insolvency administrator of myWorld International AG (Case No. 27 S 129/25k), we have engaged KPMG to carry out data preservation and forensic data analysis. The objective is, on the one hand, to identify payment flows that may be relevant for avoidance actions or liability claims. In addition, the analysis is intended to determine the point at which the company became materially insolvent and to identify deficiencies in the audited financial statements.

The joint engagement was also appropriate because the debtor’s data had been stored on the IT systems of myWorld International AG, and the insolvency administrator of that company had already secured not only its own data but also the data relating to our debtor.

The insolvency administrator of Lyconet Austria GmbH explicitly reports that, together with the insolvency administrator of myWorld International AG, KPMG has been commissioned to conduct data backup and analysis. The aim is, in particular, to investigate payment flows relevant to liability and avoidance actions, as well as to review the economic development of the group of companies.

At the same time, international asset searches are continuing. Even assets of the insolvency estate – including holdings in numerous foreign companies, the myWorld brand , real estate, and a Learjet 75 – are being liquidated or offered for sale.

The insolvencies of the myWorld group of companies do not mark the end of the investigation, but rather its beginning.

Especially in the case of internationally operating distribution systems, previous economic interrelationships, corporate structures and personal networks can still be important years later for insolvency proceedings, asset searches or official investigations.

Those who possess reliable information can help to clarify open questions and support the international investigation.
